1. INTRODUCTION

1.1. These standard Terms and Conditions constitute a legally binding agreement made between you (“you”) and Jenni Rivett - Train Like A Woman (“Us”/ “We”), concerning your access to and use of this website (“Website”), as well as the terms and conditions on which our Product/s are sold/made available to you.

1.2. You agree that by accessing the Website and making use of our Products, you have read, understood, and agreed to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Website or our Products and you must discontinue use immediately.

1.3. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the Last Updated date of these Terms and Conditions, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms and Conditions by your continued use of the Website or our Products after the date such revised Terms and Conditions are posted.

1.4. The Website is provided “as is” and on an “as available” basis. We give no warranty that the Website will be free of defects and/or faults or that it is free from computer viruses or any other contaminating computer programs.

2. DEFINITIONS

2.1 The following definitions shall apply to these Terms and Conditions:

2.1.1 “Customer”/“you” means any person who visits the Website and registers as a User;

2.1.2 “Jenni Rivett – Train Like A Woman” means Jenni Rivett trading as Jenni Rivett – Train Like A Woman;

2.1.3 “Parties” means Jenni Rivett - Train Like A Woman and the Customer, and “Party” means either one of the Parties, as the context may indicate;

2.1.4 “Product/s” means the fitness/health programme/s designed and made available by Jenni Rivett - Train Like A Woman to the Customer, pursuant to these Terms and Conditions, as further described in clause 3 herein;

2.1.5 “Terms and Conditions” means the standard terms and conditions as set out herein;

2.1.6 “User” means a person who registers as a User on our Website to purchase our Product/s. Only natural persons/individuals may purchase our Products, and Customers below the age of 18 may only use this Website or register as a User under adult supervision.

3. THE PRODUCTS

3.1 Jenni Rivett - Train Like A Woman, designs fitness/health programmes which include training programme/s and/or meal plan/s for a certain number of days/weeks and may include a number of live Zoom classes presented by a trainer from Jenni Rivett – Train Like A Woman.

3.2 The available Products together with the pricing thereof (“Product Prices”) will be listed on the Website from time to time.

3.3 The Customer is required to register as a User on the Website in order to be able to purchase any Product/s.

3.4 The Customer shall select the required Product and upon payment of the Product Price, the Customer will receive an email confirming that the Product is available on the Website.

3.5 All pricing information on the Website is correct at the time of going online. We reserve the right to change prices and alter or remove any special offers from time to time in our sole discretion.

3.6 The Products are not designed for with any specific Customer in mind, and Users’ attention is drawn to the limitations of liability set out in clause 6 below.

4. PAYMENT

4.1. Once the Customer selects the desired Product/s, the Customer shall be liable for payment of the quoted Product Price, without set-off/deduction of any kind.

4.2. Payment must be made electronically to the bank account of Jenni Rivett - Train Like A Woman as indicated on the Website.

4.3. Upon receipt of payment, the Customer will receive immediate access to the Product/s selected.

5. INTELLECTUAL PROPERTY

5.1. Unless otherwise expressly indicated, all intellectual property rights including, but not limited to, copyright, trademarks and logos used on the Website or in the Products, is licensed to or is owned by Jenni Rivett – Train Like A Woman and are protected by copyright and trademark laws.

5.2. The Customer does not obtain any right, title or interest in/to such intellectual property and may not copy, reproduce, modify, distribute, republish, display, post or transmit any part of the Website and specifically any Product/s or element of any training programme without the permission of Jenni Rivett - Train Like A Woman.

6. LIMITATIONS OF LIABILITY

6.1. In no event will Jenni Rivett - Train Like A Woman or its directors, employees, or agents be liable to the Customer or any third party for any death, injury or harm, including but not limited to any physical injuries, direct, indirect, consequential, or special damages arising from your use of the Website or the Products.

6.2. You understand that engaging in physical exercise carries inherent risks, and you voluntarily assume all risks associated with such activities. It is your responsibility to assess your own physical condition and abilities before using any of the Products. We strongly recommend consulting with a healthcare professional before beginning any new exercise program, particularly if you have any pre-existing medical conditions, injuries, or health concerns. The information provided on our Website is for general informational purposes only and does not constitute medical advice. The Products are not intended to diagnose, treat, cure, or prevent any medical condition.

6.3. Jenni Rivett - Train Like A Woman gives no warranty, express or implied, concerning the suitability, results or effectiveness of the Products provided. Individual results may vary significantly based on various factors including, but not limited to, individual health conditions, genetics, diet, adherence to the program, and other lifestyle factors.

6.4. Jenni Rivett - Train Like A Woman is not responsible for any lack of results or desired outcomes experienced by individuals using the Products. By purchasing and using our Products, you acknowledge that achieving specific fitness goals requires time, effort, and dedication, and that results are not guaranteed.

6.5. We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship. Jenni Rivett - Train Like A Woman is not liable for any damage or losses (including, but not limited to, corruption or destruction of data) resulting from your use of or inability to use the Website/access any of our Products.

6.6. This Website may contain links to other sites. Unless expressly stated, these sites are not under the control of Jenni Rivett- Train Like A Woman. We assume no responsibility for the content of such websites and disclaim liability for any and all forms of loss or damage arising out of the use of those sites. 7. INDEMNIFICATION

7.1. The Customer hereby indemnifies Jenni Rivett - Train Like A Woman, its directors, employees and agents against any claims, costs and expenses of whatsoever nature and howsoever arising out of:

7.1.1. breach by the Customer of any of these Terms and Conditions; and/or

7.1.2. any breach of the Customer representations and warranties set forth in these Terms and Conditions or upon registration as a User.

8. USER REPRESENTATIONS

8.1. By using the Website and registering as a User, you represent and warrant that:

8.1.1. you are a natural person and any Product/s purchased by you will be for your own personal use;

8.1.2. you are older than 18 (eighteen) years or assisted by an adult;

8.1.3. all registration information you submit will be true, accurate, current, and complete;

8.1.4. you will maintain the accuracy of such information and promptly update such registration information as necessary;

8.1.5. you have the legal capacity and you agree to comply with these Terms and Conditions;

8.1.6. you will not access the Website through automated or non-human means, whether through a bot, script or otherwise;

8.1.7. you will not use the Website or any Product created by us for any illegal or unauthorized purpose;

8.1.8. you will not make your username/password available to any other person;

8.1.9. your use of the Website will not violate any applicable law or regulation.

8.2. If you provide any information that is untrue, inaccurate, not current, or incomplete, Jenni Rivett - Train Like A Woman has the right to suspend or terminate your use of the Website or any of our Products.

10. TERMINATION AND CANCELLATION OF USER REGISTRATION

10.1. Jenni Rivett – Train Like A Woman may terminate your User Registration or access to the Website at any time in our sole discretion and we reserve the right to terminate without giving reasons.

10.2. You may terminate your registration at any time, provided that no further Products will be available for purchase unless you have a valid account.

11. POPI

11.1. The Customer hereby consents to the storage and use by Jenni Rivett - Train Like A Woman, in accordance with the provisions of the Protection of Personal Information Act No.4 of 2013 (“POPI”), of the personal information that you provide when registering as a User.

11.2. Jenni Rivett - Train Like A Woman shall protect the Customer’s personal information, in accordance with the provisions of POPI and shall use the information for the purposes of providing the Products, further developing the Products and offering thereof, processing payments and generally to comply with these Terms and Conditions.

11.3. Upon the request of the Customer, Jenni Rivett - Train Like A Woman shall provide the Customer with detail of all personal information held of the Customer or shall destroy all such personal information and certify to the Customer that it has done so; unless legislation imposed upon Jenni Rivett - Train Like A Woman prevents it from returning or destroying all or part of the personal information.

12. BREACH

12.1. The Customer agrees that if the Customer breaches any Terms or Conditions herein, Jenni Rivett - Train Like A Woman is entitled to:

12.1.1. immediately suspend the access to any Product/s to the Customer;

12.1.2. terminate this agreement and any Product to be provided in terms hereof.

12.2. These remedies are without prejudice to any other rights Jenni Rivett - Train Like A Woman may be entitled to in terms of these Terms and Conditions or in law.

13. MISCELLANEOUS

13.1. These Terms and Conditions constitute the entire agreement and understanding between the Customer and Jenni Rivett - Train Like A Woman.

13.2. Jenni Rivett - Train Like A Woman’s failure to exercise or enforce any right or provision of these Terms and Conditions shall not operate as a waiver of such right or provision.

13.3. Jenni Rivett - Train Like A Woman may cede or assign any or all of its rights and obligations to a third party at any time without the consent of the Customer.

13.4. Jenni Rivett - Train Like A Woman shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond its reasonable control.

13.5. If any provision or part of a provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and Conditions and does not affect the validity and enforceability of any remaining provisions.

14. GOVERNING LAW

The Jenni Rivett - Train Like A Woman Website is hosted, controlled and operated from the Republic of South Africa and therefore the Website as well as these Terms and Conditions are governed by South African law.
